These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and The Homely Treasures LLC ("we," "us" or "our"), concerning your access to and use of our website, as well as any other media form, mobile application, or software related, linked, or otherwise connected thereto.

1. Agreement to Terms

By accessing the Site or utilizing our applications, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Site and our services and you must discontinue use immediately.

2. Intellectual Property Rights

Unless otherwise indicated, the Site, our mobile applications, and our software products are our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the “Content”) and the trademarks, service marks, and logos contained therein are owned or controlled by us, and are protected by copyright and trademark laws.

3. User Representations

By using our services, you represent and warrant that:

1. You have the legal capacity and you agree to comply with these Terms of Service;
2. You are not a minor in the jurisdiction in which you reside;
3. You will not access the Site or applications through automated or non-human means, whether through a bot, script, or otherwise;
4. You will not use the services for any illegal or unauthorized purpose; and
5. Your use of the services will not violate any applicable law or regulation.

4. User Accounts and Termination

To access certain features of our applications, you may be required to register an account. You agree to keep your password confidential and will be responsible for all use of your account. We reserve the right to remove, reclaim, or change a username you select if we determine it is inappropriate. We also reserve the right, in our sole discretion and without notice or liability, to terminate or suspend your account and deny access to the applications to any person for any reason, including without limitation for breach of any representation, warranty, or covenant contained in these Terms.

5. User-Generated Content (UGC)

Our applications may invite you to chat, contribute to, or participate in blogs, message boards, and other functionality, and may invite you to create, submit, post, display, or transmit content, including but not limited to text, writings, video, audio, photographs, or graphics (collectively, "Contributions").

Contributions must not be offensive, harassing, defamatory, obscene, or violate any third-party rights. We reserve the right to review, monitor, filter, or delete any user contributions that violate these Terms or are deemed harmful, in our sole discretion, to comply with mobile app store safety guidelines.

6. Service Appointments and Loyalty Programs

Certain mobile applications developed by us may offer appointment booking features, connection to local service providers, and loyalty programs (points, tokens, or rewards):

• Third-Party Service Providers: Appointments, bookings, or services are fulfilled by independent, third-party authorized service centers or providers. The Homely Treasures LLC does not guarantee the quality, safety, performance, or legality of the services provided by these third-party centers. Any disputes arising from such services must be resolved directly with the respective service provider.
• Loyalty Points and Rewards: Points, tokens, or rewards earned, tracked, or spent within our applications have no cash value and cannot be redeemed for cash. They can only be used as discounts or promotional benefits at participating partners or service centers under the specific rules of active campaigns. We reserve the right to modify, suspend, or terminate these promotional campaigns and loyalty programs at any time without prior liability.

7. Limitations of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, mobile applications, or our software products, even if we have been advised of the possibility of such damages.

8. Governing Law

These terms and your use of the Site and applications are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any legal action or dispute arising under these Terms shall be brought exclusively in the applicable courts located in Wyoming.
